TERMS AND CONDITIONS

These terms and conditions govern participation in the Hilti Australia Competition 2024. The following description and procedure refers to a social media competition for construction professionals who have their own social media profiles on Instagram @hiltiaustralia (Competition).

 

^General

The organiser of the Competition is Hilti Aktiengesellschaft, Feldkircherstrasse 100, 9494 Schaan, Liechtenstein (Hilti). The Competition is not connected to Instagram and is in no way sponsored, supported or organised by Instagram. Instagram is not the contact for the Competition. The recipient of the data and information provided by the participant is not Instagram, but Hilti.

By entering the Competition, these terms and conditions are expressly accepted.

 

^Prize

The prizes are a Hilti stubby holder and utility knife for weekly winners and a cooler bag, cap, and construction pen for the overall Competition winner. The prizes will be sent out after the winner's address has been announced.

 

^{Eligible participants}

Hilti Australia customers and fans are eligible to participate. Hilti employees and public authorities are excluded from participation. The Competition period is from 9:00am on 6 May 2024 until 11.59pm on 28 May 2024.

 

^{Participation in the Competition}

The following steps are required to enter the Competition.

An eligible participant who works in construction can take part over the course of three (3) weeks. The eligible participant can publish on their own social media profile a social media post of which the user is the owner. The post or reel will be published with the hashtag #hiltiAUchamps.

Each week, there will be a different topic. At the end of the three (3) week Competition period, Hilti will nominate a maximum of three (3) selected photos or videos from the community. The community will vote on their favourite post on the Instagram profile @hiltiaustralia. The winning post will be published on @hiltiaustralia. At the end of the Competition period the overall winner will be nominated based on the number of wins or, if there are several participants with the same amount of wins, the overall Competition winner will be voted upon based on community votes on Hilti Australia’s Instagram feed. By participating in this Competition, the user agrees to the republishing of the participating content on Hilti’s social media profiles as well as on the Hilti website.

The winning participants (Winners) will be announced on @hiltiaustralia at the latest on Monday after each Competition week concludes and will be informed about the prize in a timely manner thereafter. The winner will be contacted via direct message on Instagram and asked for an email address. Hilti will confirm the prize by email and ask for communication regarding further details or a shipping address. Once the shipping address has been confirmed, the prize will be sent to the addresses provided by 31 May 2024. Hilti will bear the shipping costs incurred.

If the winner does not contact Hilti within four (4) weeks of confirmation of the prize, the prize will be forfeited without entitlement to compensation. No other winner will be chosen to take the place of the first winner.

 

^{Changes to the Competition}

Hilti reserves the right to adjust, change or cancel the Competition if the need arises.

 

^{Premature termination of Competition as well as changes}

In the event of unforeseeable circumstances which result in the Competition being unable to be conducted in an appropriate manner (as determined solely by Hilti), Hilti reserves the right to change or terminate the Competition without notice to the participants. Premature termination or changes may apply, in particular, if attempted misuse or manipulation is detected.

 

^{Data protection}

Hilti will use your personal data only as necessary and for the purpose(s) of the Competition (e.g., prize draw, delivery). Your personal data will only be further utilised if it is required by applicable law or with your consent. As soon as Hilti no longer requires your personal data it will be erased in accordance with the retention periods outlined in our Privacy Policy, available here.

Your data will only be transmitted to Hilti internal departments that are involved in the execution of the respective processes related to the Competition (e.g., accounting and marketing) and our processors, as required.

^{Release and limitation of liability}

By entering the Competition, participants release and hold harmless Hilti and its respective subsidiaries, assigns, employees, officers and directors from any liability, illness, injury, death, loss, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:

a) such participant’s involvement in the Competition;

b) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment;

c) the unavailability or inaccessibility of any transmissions, or Internet service;

d) unauthorized human intervention in any part of the entry process or the Competition; and

e) electronic or human error in the administration of the Competition or the processing of entries.

 

^{Governing law and jurisdiction}   

The Competition and these terms and conditions will be governed by New South Wales law and any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
